Compliance with Export Regulations
(A) Under the provisions of the International Traffic in Arms Regulations (“ITAR”), the United States Department of State controls the export of United States Munitions List articles, including certain products sold on this website. The United States Department of State export licenses are required for the export of items subject to control under ITAR.
(B) Under the provisions of the Export Administration Regulations (“EAR”), the United States Department of Commerce controls the export of certain “dual-use” commodities. Certain products sold herein are controlled under the Commerce Control List (“CCL”) of the EAR.
(C) By proceeding with a transaction to purchase any ITAR or EAR restricted item(s), the customer certifies that (i) the purchase does not require the seller to export such items; (ii) the customer does not intend to export, transfer, sell, or furnish the item to any foreign person, whether abroad or in the U.S., without the appropriate U.S. Government export authorization.
(D) The customer shall not engage in the re-export, transfer, transshipment, diversion, reshipment, or re-sale of seller’s products outside of the United States, without the prior written consent of the seller.
(E) Customer is hereby advised that under United States law serious penalties may be assessed against the seller, against its personnel, and, consistent with limitations on the jurisdiction of the United States law enforcement agencies and United States courts, against seller for misrepresentations of fact, material omissions, failure to comply with export license conditions, violation of export license conditions, and failure to provide required information in completing or supplementing the applications or licenses under the ITAR and EAR regulations. Apart from penalties under law, any misrepresentation of fact or material omission by customer, and any failure to comply with United States law and regulations shall constitute grounds for cancellation of any orders by the seller, and may result in the forfeiture by customer of any and all amounts or products owed to customer by seller.
(F) By proceeding with a transaction to purchase any products from the seller, customer acknowledges that customer has read, understood, and shall comply with all applicable ITAR and EAR regulations, whether or not such be specifically described or referred herein.
